The court upheld a lower court’s decision to block the order nationwide, citing the 14th Amendment to the US Constitution, which guarantees citizenship to anyone born on US soil.
The ruling was made by a three-judge panel of the 9th US Circuit Court of Appeals on July 23, 2025, which affirmed that denying citizenship to children born to people in the US illegally or temporarily would be unconstitutional. The court rejected Trump’s attempt to reinterpret the Citizenship Clause of the 14th Amendment.
